Terms and Conditions of Use and Sale

Article 1 — Definitions and scope

These General Terms and Conditions of Use and Sale (the "Terms") govern access to and use of the Fuelnode mobile application (the "App"), the website fuelnode.fr (the "Site"), the AI-generated sports nutrition protocols (the "Protocols"), and the subscription-based delivery of sports nutrition products (the "Box" or "Boxes").

Any natural person who creates an account and uses the App is referred to as the "User" or "Subscriber." By creating an account, the User acknowledges having read, understood, and accepted these Terms in their entirety.

Fuelnode is a sports nutrition personalization and product delivery service. Fuelnode is not a healthcare provider, medical device, dietitian practice, or pharmaceutical service. The Protocols are generated by artificial intelligence and are intended solely as general sports nutrition guidance for healthy adults engaged in endurance sports activities.

Article 2 — Description of services

2.1 Free tier

The Free tier provides access to the onboarding quiz, basic macro targets, weekly learning cards, and a race calendar. No physical products are delivered. No payment is required.

2.2 Amateur subscription

The Amateur subscription includes a biweekly delivery of 8–10 curated sports nutrition products, a personalized AI-generated biweekly fueling protocol, product-specific science cards, a 14-day calendar protocol card, and QR-linked feedback functionality.

2.3 Performance subscription

The Performance subscription includes a weekly delivery of 7–8 curated sports nutrition products, a weekly adaptive AI-generated protocol with specialist trigger activation, wearable integration (Garmin Connect, Apple Health), post-race feedback loops, protocol changelog tracking, and seasonal inserts.

2.4 Elite subscription

The Elite subscription includes all Performance features plus 9–10 premium-brand products weekly, nutritionist coaching notes, A-race kits included at no additional charge, priority WhatsApp support, quarterly branded accessories, and a premium brand mix.

2.5 Race Packs

Race Packs are one-time purchases available to all Users (subscribers and non-subscribers). Each Race Pack contains products and a protocol tailored to a specific race distance: Semi-Marathon, Marathon, Ultra/Trail, or Ironman. Race Packs are non-subscription and do not auto-renew.

2.6 AI-generated protocols

Protocols are generated by artificial intelligence (Claude API, Anthropic Inc.) based on the User's profile data, training information, dietary preferences, and feedback. The AI system is not a certified dietitian, nutritionist, or medical professional.

Article 3 — Account creation and eligibility

The User must be at least 18 years of age and a resident of metropolitan France to subscribe. By creating an account, the User warrants that the information provided is accurate, complete, and current.

Article 4 — Subscription, pricing, and payment

Current pricing:

• Free: €0 — protocol only, no box
• Amateur: €24,90 / weekly box (8 products)
• Performance: €34,90 / weekly box (10 products)
• Elite: €64,90 / box every 2 weeks (17 products)
• Home delivery supplement: +€2.50 / box

Payment is processed via Stripe. Accepted methods include credit/debit card (CB, Visa, Mastercard), Apple Pay, and Google Pay.

Article 5 — Subscription management

All subscriptions operate on a no commitment basis. The User may cancel at any time via the App, the Site, or by contacting support@fuelnode.fr. Cancellation takes effect at the end of the current billing cycle. Users may pause for up to 4 cumulative weeks per year. Tier changes are available at any time.

Article 6 — Delivery

Default delivery is via Mondial Relay relay point. Home delivery is available at +€2.50 per box. Delivery is currently available within Paris and Île-de-France. Missing, damaged, or incorrect boxes must be reported within 48 hours to support@fuelnode.fr.

Article 7 — Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Code de la consommation, the User has a right of withdrawal of 14 calendar days from the date of delivery of the first Box. Products must be returned unused, sealed, and in their original condition. Perishable products and opened products are excluded from the right of withdrawal.

Article 8 — Allergens and product safety

Fuelnode curates products from third-party sports nutrition brands. Users are solely responsible for verifying product labels before consumption, particularly with respect to allergens.

Article 9 — Intellectual property

All content within the App and Site is the exclusive property of Fuelnode or its licensors and is protected under applicable intellectual property laws.

Article 10 — Limitation of liability

Fuelnode provides sports nutrition guidance and product curation services. Fuelnode does not provide medical advice. Fuelnode's aggregate liability shall not exceed the total amount paid by the User in the 12 months preceding the claim.

Article 11 — Force majeure

Fuelnode shall not be liable for any delay or failure to perform obligations resulting from events beyond its reasonable control.

Article 12 — Modifications to the Terms

Fuelnode reserves the right to modify these Terms at any time. Users will be notified of material changes at least 30 days before they take effect.

Article 13 — Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of France. Any dispute shall first be subject to amicable resolution. Failing that, the competent courts of Paris shall have exclusive jurisdiction. Online dispute resolution: https://ec.europa.eu/consumers/odr.
